Justice Feroza Bhabha imposed the maximum sentence on Gibbons Sept. 11, finding her guilty of disobeying a court order to not protest within the "bubble zone" around the Morgentaler Clinic. She was arrested on June 11 and has been imprisoned since then. Taking into account time already in custody, Gibbons will remain incarcerated until Oct. 10.
Gibbons has spent more time in jail than out over the past two decades as she continues to carry on her protests despite a temporary injunction in 1994 that prohibits demonstrations outside the clinic.
Justice Bhabha said that a strong message needs to be sent to the diminutive 64-year-old grandmother who is "a martyr for her cause" and "very likely" to be before the court again, reported LifeSiteNews. The justice went on to say that the democratic process allows Gibbons other avenues besides lawbreaking to protest against laws with which she disagrees. She added that Gibbons was not amenable to rehabilitation and that her conduct needs to be denounced.
Defence counsel Daniel Santoro said he will appeal the conviction, along with two previous convictions, arguing the 1994 injunction does not apply to Gibbons.
